  7.                              END USER AGREEMENT

  9. BY USING THIS SOFTWARE, YOU AGREE TO ABIDE BY THE TERMS OF THIS END USER
  10. AGREEMENT.

  12.     Subject to the terms and conditions provided below, Friendly Software,
  13. located at http://www.yourfriends.com ("Friendly Software") hereby grants
  14. the following license to you for the Bill Time Logger software (the
  15. "Software").
  16.  
  17. 1. Grant of License.  Friendly Software grants to you a non-exclusive,
  18. non-transferable license to install and use the Software on your computer.
  19. Such license grant is conditioned upon the following limitations: (i) 
  20. you do not reverse engineer, decompile or disassemble the Software.
  21.  
  22. 2. Term of License.  If you are using the Demo version, this license grants
  23.  you a thirty (30) day trial period to evaluate the usefulness of this
  24. software.  After the trial period, you must either register the software, or 
  25. discontinue using it.  If you are using the registered version, this license 
  26. is effective until terminated.  You may terminate it any time by deleting 
  27. the Software and all accompanying documentation and copies thereof from your 
  28. computer.  This license will terminate automatically if you fail to comply 
  29. with any term or condition of this Agreement.

  31. 3. Intellectual Property.  All rights to the Software and all copyrights,
  32. patents, trademarks, service marks, or other proprietary rights relating
  33. thereto are and shall remain with Friendly Software.  You acknowledge that 
  34. no rights, title, or interest in these items is granted under this 
  35. Agreement.  Authorized copies of the Software shall contain all copyright 
  36. notices or proprietary legends that are contained or embedded in the 
  37. Software.

  39. 4. Limited Warranty.  If the Software was provided on media, Friendly 
  40. Software warrants that the media on which the Software is furnished to you 
  41. is free from defects in materials and workmanship under normal use for 
  42. ninety (90) days after you obtain the Software or Friendly Software will 
  43. replace the Software.
  44.  EXCEPT AS PROVIDED HEREIN, THE SOFTWARE IS PROVIDED "AS IS" AND WITHOUT
  45. EXPRESS OR IMPLIED WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO,
  46. IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE,
  47. AND ALL SUCH OTHER WARRANTIES ARE EXPRESSLY DISCLAIMED.

  49. 5.  Limitation of Liability.  EVERY EFFORT HAS BEEN MADE TO INSURE THE
  50. INTEGRITY OF THE BILL TIME LOGGER PROGRAM.  IN NO EVENT WILL FRIENDLY 
  51. SOFTWARE BE LIABLE TO YOU OR ANY OTHER PARTY FOR ANY LOST PROFITS, LOST 
  52. SAVINGS OR OTHER INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, 
  53. EVEN IF FRIENDLY SOFTWARE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH 
  54. DAMAGES.  IN NO EVENT SHALL FRIENDLY SOFTWARE'S LIABILITY EXCEED THE FEE 
  55. PAID FOR THE SOFTWARE.

  57. 6.  General.  If any provision or part of any provision of this Agreement
  58. shall be held invalid or unenforceable, such part shall be ineffective
  59. without in any way affecting the remaining parts of such provision or the
  60. remaining provisions of this Agreement.  
  61.  
  62. 7.  Export Compliance. You agree to comply with applicable U.S. export laws
  63. and regulations in connection with the acquisition, use and transfer of the
  64. Software. 
  65.  
  66. 8.  Government End Users.  The Software is subject to Restricted Rights and
  67. is subject to the restrictions set forth in the applicable Federal
  68. Acquisitions Regulations.
  69.  
  70. CERTAIN JURISDICTIONS PROVIDE FOR GREATER RIGHTS THAN WHAT IS PROVIDED IN
  71. THIS AGREEMENT.  YOUR RIGHTS WITH RESPECT TO THIS AGREEMENT MAY VARY
  72. DEPENDING ON YOUR JURISDICTION.
